Sales Contract And Waiver of Liability
Quad Streamer units (here-in-after “an After-Market Air Induction Tube device” or “product”) for installation and use in a gasoline or diesel powered motor vehicle(s) from Quad Streamer LLC, a Wisconsin limited liability company. Accordingly, I agree to the following terms and conditions of purchase and waive the following rights as detailed below:

TERMS & CONDITIONS
This contract is intended for usage in sales and distribution of the Quad Streamer device. This product sale is not intended to be understood by a client to be an “arms-length” business transaction, therefore Quad Streamer LLC does not make any representations or guarantees that may be customarily associated with such products in the market. The customer understands and agrees that by installing this product, the customer (end user) assumes all risks associated with the usage of this device, including but not limited to: the preparation prior to, during, and after the installation of the device.  BY ACCESSING OR USING ANY PART OF THE SITE (INCLUDING BY PLACING AN ORDER THROUGH THIS SITE), YOU AGREE TO BE BOUND BY THIS AGREEMENT.  IF YOU DO NOT AGREE, OR IF YOU DO NOT UNDERSTAND THE TERMS OF THIS AGREEMENT, DO NOT ACCESS OR USE THE SITE.

DESCRIPTION OF THE PRODUCT 

 

The Quad Streamer is a device intended to split 1 air flow into 4 streams of air when placed inside an air induction tube. It is designed to cut the turbulence of air that goes from the air filter box into the engine. It is composed of a single piece of flexible Nylon which is resistant to oils, gasoline, and extreme temperatures. But is only subjected to ambient temperature. The Quad Streamer easily fits inside the air induction tube of a vehicle with inside diameters from 1 inch to 4 inches. The device may need slight modifications depending on the application. See installation instructions available at www.quadstreamer.com. The Quad Streamer is compatible with the majority of gasoline or diesel powered personal vehicles, tractors, trucks, certain motorcycles, 4-wheelers, and industrial equipment, so long as it has an air induction tube diameter of 4” or less . It is sold by Quad Streamer LLC, and is Made in the USA.
NOTE: Naturally aspirated or carburetor vehicles will need an after market air induction tube kit, to hold it in place. (The kit can currently be purchased separately online and at various automotive stores).

 

QUAD STREAMER GUARANTEE
Our customers have reported positive results in gas mileage, and/or better performance of their vehicle. However, Quad Streamer LLC can not guarantee or represent how the Quad Streamer device enhances or materially affects the performance of a vehicle in any way. Quad Streamer LLC can not make any representations as to its effect on air intake, gasoline mileage, or carbon emissions resulting from the use of this device unless or until all certified lab testing is complete. Quad Streamer LLC can not guarantee the quality of this product, however, it is our intent to provide a product free of defects to the customer. Quad Streamer LLC does not promise to service any customers with trouble shooting needs regarding this product. Quad Streamer is not liable for installation into vehicles that are not in good running condition. (Example: Your “Check Engine” light is on,( means your vehicle requires service prior to installation of a Quad Streamer).

WAIVER OF LIABILITY
By installing the Quad Streamer, (You) the customer assumes all risks and liability for any damages stemming from the installation and/or use of the Quad Streamer device in a vehicle of any kind. Quad Streamer LLC is not responsible for any bodily injuries or property damage. The customer agrees to hold harmless Quad Streamer LLC against any claim, judgment, or settlement for damages, court costs, expert witness fees, attorney fees, or other expenses arising out of a complaint, claim, or lawsuit to the extent that the complaint, claim, or lawsuit is caused by alleged defective or negligent manufacture, assembly, modification made by the customer or installer of the device, or design of the device or accessory by the manufacturer, importer, or distributor.

 

UNREGULATED MOTOR VEHICLE PART 
The Quad Streamer is an unregulated motor vehicle part and is not registered with any federal or state agency. The device has not undergone any controlled testing by any accredited laboratory at this time, however, Quad Streamer LLC does plan on doing accredited laboratory test(s) in the future.

LIMITED REPLACEMENT WARRANTY
Your product comes with a Limited Replacement Warranty. Quad Streamer LLC warrants your product from manufacturing defects, and for normal wear and tear under normal use for up to 5 years of the original purchase date. Warranty may not be transferred. Registration is required by mailing the Product Registration form, or registering online at http://www.quadstreamer.com. Registration is required within 60 days of the purchase date. 

Replacement Warranty-Extent of Warranty

Quad Streamers are warranted against defective materials or workmanship for five years only from the date of purchase. Our warranty covers the original purchaser of a Quad Streamer product who has provided proper proof of original retail purchase. Any defective Quad Streamer device that is properly returned to Quad Streamer,LLC will be replaced at the discretion of Quad Streamer, LLC. Quad Streamer LLC. reserves the right to determine whether the terms of the warranty, set out above, have been properly complied with. In the event that the terms are not complied with, Quad Streamer LLC. shall be under no obligation to honor this warranty. Quad Streamer LLC. will not be responsible for any indirect, consequential, special, contingent, or other damages.
Consumer Protection Pledge
We here at Quad Streamer LLC. are confident that the purchase and installation of a Quad streamer will in no way affect your vehicle warranty, but are not responsible for any denied claims. Please check with your vehicle manufacturer or warranty company for warranty information prior to installing your Quad Streamer(s).

Clear Gifs Information: When you use the Site or services, we may employ clear gifs (a.k.a. Web Beacons) which are used to track the online usage patterns of our users anonymously. No personal information from your account is collected using these clear gifs. In addition, we may also use clear gifts in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make this Site better for our users.

Quad Streamer reserves the right, but has no obligation, to monitor the User Content you post on the Site. Quad Streamer has the right to remove any such information or material for any reason or no reason including, without limitation, if in its sole opinion, such information or material violates, or may violate, any applicable law or our Terms of Use, or to protect or defend Quad Streamer’s rights or property or those of any third party. Quad Streamer also reserves the right to remove information upon the request of any third party.
We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our Site and services; (d) monitor aggregate metrics such as total number of visitors and traffic; (e) diagnose or fix technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP; and (f) help you efficiently access information.

We may store personal information in locations outside the direct control of Quad Streamer LLC. (for instance, on servers or databases co-located with hosting providers).
As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers, or dissolution.
Except as otherwise described in this Privacy Policy, Quad Streamer LLC.will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use , take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Site; and (c) to exercise or protect the rights, property, or personal safety of Quad Streamer LLC, our users or others.

We fully cooperate with law enforcement agencies in identifying those who use our Site or services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. Release of your personal information for security purposes, as described in this agreement to any person or entity under any circumstances shall be based on a determination made solely by us, exercising our own discretion, permission for which is expressly granted by you to us in accordance with this Privacy Policy.
Non-Personally Identifiable Information: We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain services.
Quad Streamer LLC. allows other companies, called third-party ad servers or ad networks, to serve advertisements on the Site. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Site. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content.
Quad Streamer LLC. does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. We cannot, however, ensure or warrant the security of any information you transmit to Quad Streamer LLC. or the Site and you do so at your own risk. Once we receive your transmission of information, Quad Streamer LLC. makes reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. While we strive to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online.

Compromise of Personal Information
In the event that personal information is compromised as a result of a breach of security, Quad Streamer LLC. will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.
Children's Privacy
Protecting the privacy of young children is especially important. For that reason, Quad Streamer LLC. does not knowingly collect or solicit personal information from anyone under the age of 18. You must be 18 years of age to use this site. If you are under 18, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 is allowed to provide any personal information to or on this Site. In the event we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will delete that information as quickly as possible.

Quad Streamer LLC. invites you to socialize and share your experiences with a Quad Streamer using Social Media tools such as Facebook, Twitter, Pinterest, LinkedIn, YouTube, Google+ and Instagram. If you choose to use these tools, you may be sharing certain profile elements, including your comments. This sharing is subject to each social media program’s privacy policies. We also use Facebook Social Plugins to allow Facebook to share information and friends’ activities with its members while they are on our Site. For example, Social Plugins allow Facebook to show you your friends’ "Likes" on our product pages if you are logged into Facebook while using the services on our Site. Quad Streamer LLC. does not receive or control any of the content from Facebook Social Plugins.
